6. Pricing and Payment Terms

  • Custom/personalized items cannot be cancelled once production begins

7.5 Order Verification

Failure to respond within 48 hours may result in order cancellation.

7.6 Stock Availability

All transactions and relationships between you and Luvvies are subject to Pakistani law, including but not limited to:

  • Electronic Transactions Ordinance, 2002

18.2 Jurisdiction and Venue

Subject to the arbitration provision below, you agree that:

  • Exclusive jurisdiction: Courts in Abbottabad, Khyber Pakhtunkhwa, Pakistan shall have exclusive jurisdiction over any disputes
  • Venue: Any legal proceedings must be brought in courts located in Abbottabad
  • Waiver of objection: You waive any objection to venue or inconvenient forum

18.3 Mandatory Pre-Dispute Resolution

Before initiating any legal action, you agree to:

  • Provide us 30 days to investigate and respond

Step 2: Mediation (Optional, 30 Days)

  • If direct communication fails, either party may propose mediation
  • Mediation conducted in Abbottabad by mutually agreed mediator
  • Each party bears their own mediation costs

18.4 Arbitration (Optional)

For disputes involving amounts less than PKR 100,000, parties may agree to binding arbitration instead of court proceedings:

  • Arbitration Rules: Conducted under Pakistan Arbitration Act, 1940
  • Arbitration Seat: Abbottabad, Pakistan
  • Language: English and/or Urdu
  • Arbitrator: Single arbitrator mutually agreed upon
  • Decision: Final and binding, enforceable in Pakistani courts
  • Costs: Each party bears their own costs unless arbitrator decides otherwise

18.5 Small Claims Exception

Notwithstanding the above, either party may bring a claim in small claims court if it qualifies for such jurisdiction.

18.6 Class Action Waiver

You agree that disputes will be resolved individually and not as part of any class, consolidated, or representative action. You waive any right to participate in class actions against Luvvies.

18.7 Injunctive Relief

Nothing in this section prevents either party from seeking injunctive or equitable relief in court for:

  • Intellectual property infringement
  • Breach of confidentiality
  • Unauthorized access to systems
  • Violation of data protection laws

18.8 Time Limitation on Claims

Any claim or cause of action arising from these Terms or use of our Services must be filed within ONE (1) YEAR after the claim arose, or it shall be permanently barred.
